Republicans battle over undecided voters in Iowa (AP)

DES MOINES, Iowa ? With time running short, Republican presidential candidates Rick Santorum, Rick Perry and Newt Gingrich battled Thursday to win over a pivotal crop of undecided conservative voters. Of all the candidates, only Mitt Romney seemed to largely escape attack as he worked to win a state that long seemed out of reach until this week.

"Don't settle for what's not good enough to save the country," the newly ascendant Santorum implored Iowans at city hall in Coralville, urging voters to put conservative principles above everything else and suggesting that his rivals, and specifically Ron Paul, lacked them.

For the first time, though, the former Pennsylvania senator became a target.

"When he talks about fiscal conservatism, every now and then it leaves me scratching my head because he was a prolific earmarker," Perry, the Texas governor, said of Santorum as the day began, referring to special spending projects members of Congress seek. "He loaded up his bill with Pennsylvania pork.'"

Santorum defended the practice as part of lawmakers' constitutional role as appropriators, telling CNBC that he owed it to Pennsylvanians to bring money to the state. He said earmarking became abused and that he would support a ban on them if he were president.

Perry also slapped at Santorum in a radio ad and in a new TV commercial that lumps him in with Minnesota Rep. Michele Bachmann, former House Speaker Newt Gingrich and Paul and says: "The fox guarding the henhouse is like asking a congressman to fix Washington: bad idea."

The maneuvering underscored the fluid ? if not convoluted ? state of the GOP presidential race as Tuesday's caucuses loom while cultural conservatives and evangelical Republicans, who make up the base of the electorate here, continue to be divided. That lack of unity paves the way for someone who is seen as less consistently conservative.

Five days out, public and private polling show Romney and Paul in strong contention to win the caucuses, with coalitions of support cobbled together from across the Republican political spectrum and their get-out-the-vote operations ? beefed up from their failed 2008 bids ? at the ready. They're the only two with the money and the organizations necessary to ensure big turnouts on Tuesday.

Three others ? Santorum, Perry and Gingrich ? will have to rely largely on momentum to carry supporters to precinct caucuses. Each was working to convince fickle conservatives that he alone would satisfy those who yearn for a nominee who would adhere strictly to GOP orthodoxy.

Bachmann, meanwhile, worked to convince backers that her cash-strapped campaign was not in disarray after a top supporter in Iowa abandoned her to back Paul.

After state Sen. Kent Sorenson bolted as her Iowa campaign chairman, Bachmann continued to bleed staff, losing her Iowa political director, Wes Enos, on Thursday. Some evangelical pastors have said they've urged her to quit the race.

Bachmann condemned Sorenson for quitting, and defiantly vowed to continue in the race.

"Iowans aren't told who to vote for. Iowans are independent and they're going to make their decisions," Bachmann said in Des Moines, on the last day of a 10-day tour of Iowa's 99 counties.

Ads, mostly negative, flooded television and radio. They filled mailboxes, too.

No less than five new TV ads were rolled out Thursday, with Romney, for one, releasing a 60-second, optimistic commercial promoting his vision for America and illustrating his confidence with his standing in the primary race. He was staying far from the fray and looking toward the general election.

"In the campaign to come, the American ideals of economic freedom and opportunity need a clear and unapologetic defense. And I intend to make it because I have lived it," Romney says in the commercial that includes patriotic images and scenes from his June campaign announcement in New Hampshire.

He's in the midst of a four-day trek that he hopes will seal victory here and give him momentum heading into the Jan. 10 New Hampshire primary, the closest thing to a must-win state for the former Massachusetts governor.

On the second day of his bus tour, Romney turned out big crowds at stops in northern and eastern Iowa, focusing on more populous areas and counties he won four years ago.

"We have a choice in this coming election of what kind of America we're going to have," Romney said at J's Home Cooking in Cedar Falls, before meeting a crowd of 500 in Mason City. "It's not just about replacing a president. It's about saving the soul of America."

He didn't acknowledge his rivals but an outside group aligned with him rolled out a new ad against Gingrich that asks, "Haven't we had enough mistakes?" and notes the former House speaker's past admissions of judgment lapses.

As Romney sailed above it all, the fight raged among his rivals elsewhere in the state, where all six candidates competing in the caucuses are spending almost all their time for the next five days.

Looking to capitalize on his burst of support in new polls, Santorum made a play for tea party backers lining up behind Paul by arguing that the Texas congressman is longer on promising sweeping change than enacting it. "The guy has passed one bill in 20 years. What makes you think he can do any of these things?" Santorum said.

He added: "We need someone who has the bold, sharp contrast not just to win the election but govern the country, not somebody who is just a little better."

And, Bachmann castigated Paul's opposition to military intervention in Iran as "dangerous." She also suggested that his opposition to the federal war on drugs amounted to supporting the legalization of cocaine and heroin.

Perry focused his criticism on all the others on the right, saying: "There are other conservatives in this contest. I readily agree. But their records don't always square with the rhetoric." And, as he argued that he was the only true outsider in the race, Perry noted that four of his rivals ? Gingrich, Paul, Santorum and Bachmann ? have a combined 63 years of experience in Washington.

"I am asking you to vote your conservative values," Perry implored.

The closest anyone got to criticizing Romney directly was when Perry was asked in Cedar Rapids about family dynasties and cited, among other families, the Romneys.

In response, Perry mentioned his own modest upbringing and said: "I'm glad you gave me the opportunity to reflect my differences with Mitt."

The worst Romney faced from his rivals were veiled shots.

Santorum said Republicans must draw a clear contrast with Obama, rather than nominate a Republican with moderate tendencies out of political expedience.

"We need someone who has the bold, sharp contrasts, not just to win the election but to govern the country. Not just someone who is a little bit better," Santorum told supporters.

Perry was asked about family dynasties and the questioner cited, among other families, the Romneys. Perry stopped short of criticizing Romney's privileged upbringing. He mentioned his own humble beginning in small-town Texas before adding: "I'm glad you gave me the opportunity to reflect my differences with Mitt."

Gingrich, for his part, spent the day trying to wrap himself in President Ronald Reagan's cloak, announcing the backing of the late president's son, Michael, and, a day earlier, support from Reagan economic adviser Arthur Laffer.

Even as the polls show him sliding, Gingrich projected an upbeat image.

"The strategy of focusing on jobs and economic growth, staying positive and being pretty relentless in answering questions at every meeting is working," he insisted.

New Google+ promo features Bill Walton and friends in a hilarious NBA Hangout

Google has been rolling out promos on TV and web for Google+, and they?re actually kind of cute. This one is no exception.

In it, former NBA players Bill Walton, Kenny Smith, Spero Dedes, Steve Kerr and Jon Barry use a Google+ Hangout to discuss YouTube clips of people playing basketball in their back yard. It?s actually hilarious.

The spots are really smart because they serve as an entertainment tutorial for those not on the service yet. Showing Google+ in action, with former NBA stars, is bound to get the attention of people who only know about Facebook when it comes to social networking.

Of course, the Google+ team just announced that the NBA has embraced the service, in a big way.

Biden: Romney content with limited success stories (AP)

WASHINGTON ? Vice President Joe Biden says GOP presidential candidate Mitt Romney favors economic policies that would help some succeed but leave most Americans behind.

Biden made the claims in an op-ed published in Friday's editions of The Des Moines Register. Biden singled out Romney in the state where the first votes will be cast in the GOP caucuses in less than two weeks.

For his part, President Barack Obama has largely refrained from counterattacking Republicans, saying he will wait until voters have settled on a nominee. But Obama's campaign has not, and Biden's column is the latest sign the Obama team believes Romney will emerge from the field.

Biden said Romney's proposals for the economy "would actually double down on the policies that caused the greatest economic calamity since the Great Depression and accelerated a decades-long assault on the middle class."

"Romney also misleadingly suggests that the president and I are creating an `Entitlement Society,' whereby government provides everything for its people without regard to merit, as opposed to what he calls an "Opportunity Society," where everything is merit-based and every man is left to fend for himself," Biden wrote.

Biden's message underscored the major theme of Obama's re-election bid, as spelled out in a speech Obama made in Kansas earlier this month: The middle class is at a make-or-break moment. The president, saddled with high unemployment, has to make the case that his is the better vision for an ongoing economic recovery for all.

Earlier this week, Romney accused Obama of deepening the economic crisis and backing policies that would redistribute wealth instead of creating equal opportunity for people to do well. Romney said his policies would turn the U.S. into an "opportunity society" while Obama's vision for an "entitlement society" would make more people dependent on government welfare.

In his op-ed, Biden responded: "The only entitlement we believe in is an America where if you work hard, you can get ahead."

Self-healing electronics trialled

Self-repairing electronic chips are one step closer, according to a team of US researchers.

The group has created a circuit that heals itself when cracked thanks to the release of liquid metal which restores conductivity.

The process takes less than an eye blink to bring the circuit back to use.

The researchers said that their work could eventually lead to longer-lasting gadgets as well as solving one of the big problems of interplanetary travel.

The work was carried out by a team of scientists and engineers at the University of Illinois at Urbana-Champaign and is published in the journal Advanced Materials.

The process works by exploiting the stress that causes the initial damage in the chips to break open tiny reservoirs of a healing material that fills in the resulting gaps, restoring electrical flow.

Cracked circuits

To test their theory the team patterned lines of gold onto glass to form a circuit.

They then either placed microcapsules 0.01mm wide directly onto the lines or added a thin laminate into which they embedded larger 0.2mm microcapsules.

In both cases the microcapsules contained eutectic gallium-indium - a metallic material chosen for its high conductivity and low melting point.

This device was then sandwiched between another layer of glass and acrylic and connected to electricity.

The researchers then bent the circuit until it cracked causing the monitored voltage to fall to zero.

They said the ruptured microcapsules then healed most of the test circuits within one millisecond and restored nearly all of the measured voltage.

The smaller capsules healed the device every time but were a little less conductive than the larger ones which had a slightly lower success rate. The team suggested that a mix of differently sized capsules would therefore give the best result.

The devices were then monitored for four months during which time the researchers said there was no loss of conductivity.

Safe space travel

The leader of the group said the theory could prove a boon to the space industry.

"The only avenue one has right now is to simply remove that circuitry when it fails and replace it- there is no way to manually go in and fix something like this," aerospace engineering professor Scott White told the BBC.

"I think the real application area that you'll see for something like this is in electronics which are incredibly difficult to repair or replace - think about satellites or interplanetary travel where it's physically impossible to swap out something."

The research is an offshoot of the university's research into extending the lifetime of rechargeable batteries.

The reason current systems fail after repeated use is often because microdamage inside the devices has disrupted the conductive flow of electrons from one end of the batteries to the other.

The team said that if they could solve the problem electric car batteries might last years longer than they do at present, making the vehicles much cheaper to maintain.

Greener gadgets

The group also claimed that the technique had the potential to offer more sustainable consumer electronic devices.

Professor White gave the example of mobile phone buttons that stopped working if repeated use had caused cracks in the circuitry below. He said self-healing systems would extend handsets' lifespans.

When asked whether profit-driven electronics makers would want this he replied: "I believe any company would want to provide their customer with the best performing product and if they don't, then other companies will step into the market to provide it.

"Basically what you see is that electronics are cycled now to give you added functionality.

"Maybe the way to do this is not to physically build new circuits and packages every time, but let's have longer lasting ones.

"Then the redesigns can be more software based or functionality driven, saving us from using up our precious resources by building millions of cellphones every year."

Berkeley protesters remain, Tucson camp shut down (Reuters)

BERKELEY, California (Reuters) ? Anti-Wall Street protesters remained in a camp of about 20 tents in the Northern California college town of Berkeley on Thursday, a day after authorities threatened to stop overnight camping.

Rising tensions over a possible eviction in Berkeley came as authorities in Tuscon, Arizona, said they had shut down a similar camp at a park in that city.

Two protesters were arrested overnight in Berkeley, one for public drunkenness and one for shoving an officer, said Sergeant Mary Kusmiss, a spokeswoman for the Berkeley Police Department.

The Occupy camp remains in the city's Civic Center Park. On Wednesday, the city distributed flyers announcing plans to enforce a 10 p.m. curfew on the site, citing a rash of violence and other criminal behavior.

Protesters on Wednesday feared that a raid was imminent, but with their encampment still in place a day later, some in the group claimed victory.

Kusmiss said protesters are allowed to be in the park from 7 a.m. to 10 p.m. She declined to say how the department would enforce the nighttime curfew or discuss what its strategy was to deal with overnight camping.

"We were very grateful that there were individuals who left voluntarily," she said.

A sister Occupy protest on the nearby campus of the University of California at Berkeley, a cradle of 1960s student activism, was broken up in November by campus police who struck some students and faculty members with nightsticks.

In Tucson, police on Wednesday night cleared camping and other equipment from an Occupy camp in a city park, officials said.

Protesters had been at the park since November 3, and there were up to 10 of them at various times, but a high number of crimes at the site led to the decision to shut it down, said city spokesman Michael Graham.

Tucson police said they arrested one demonstrator who went back to the park after it was closed for the night.

Trade group: Holiday shoppers step up buying

NEW YORK (AP) ? A trade group for U.S. malls is reporting a sharp increase in sales for the week that ended Saturday, but shoppers are still behind in holiday buying compared with a year ago.

Sales at stores opened at least a year rose 3.4 percent for the week ended Saturday, compared with the previous week, according to the International Council of Shopping Centers-Goldman Sachs Weekly Chain Store Sales Index, released Tuesday. The increase followed two consecutive weekly declines, as shoppers took a break after a record spending spree over the Thanksgiving weekend, the official start of the holiday shopping season.

Sales for the recent week rose 4.6 percent compared with a year ago.

The weekly index is a sales proxy for 24 major stores, including Target Corp, Costco Wholesale Corp. and Macy's.

'Batman' star Bale tries to visit China activist (AP)

BEIJING ? "Batman" star Christian Bale, in the midst of promoting a film he made in China that some critics have called propaganda, was physically stopped by government-backed guards from visiting a blind activist living under house arrest ? with a CNN crew in tow to record the scuffle.

CNN posted footage of the confrontation on its website Friday.

The run-in and publicity is likely to cause discomfort in China's government-backed film industry, which hopes Bale's movie "The Flowers of War" will be a creative success at home and abroad. The star's actions are sure to focus attention on the plight of Chen Guangcheng, guarded around the clock by burly, aggressive security men who have blocked dozens of reporters and fellow activists trying to see him in the past.

Bale was to leave China on Friday and his representatives could not immediately be reached for comment.

Bale, who won a best supporting actor Oscar for last year's "The Fighter," traveled Thursday with a crew from CNN to the village in eastern China where Chen, the blind lawyer, lives with his family in complete isolation.

They were stopped at the entrance to Dongshigu village in Shandong province by unidentified men.

The video footage shows Bale asking to see Chen, with a CNN producer providing interpretation, but being ordered by one of the guards to leave. He then asked why he was unable to pass through. The guards responded by trying to grab or punch a small video camera Bale was carrying.

"What I really wanted to do was to meet the man, shake his hand and say what an inspiration he is," Bale was quoted as saying by CNN.

Chen's case has been raised publicly by U.S. lawmakers and diplomats, including Secretary of State Hillary Rodham Clinton, all to no response from China.

CNN said Bale first learned of Chen from news reports when he was in China filming "The Flowers of War," China's official submission this year for best foreign language film Oscar.

"Chen Guangcheng is a newsworthy figure ... and as such it is in the interest of CNN's global viewers to hear from him," CNN said in a statement. "Mr. Bale reached out to CNN and invited us to join him on his journey to visit Chen."

Chen, a self-taught lawyer who was blinded by a fever in infancy, angered authorities after documenting forced late-term abortions and sterilizations and other abuses by overzealous authorities trying to meet population control goals in his rural community. He was imprisoned for allegedly instigating an attack on government offices and organizing a group of people to disrupt traffic, charges his supporters say were fabricated.

Although now officially free under the law, he has been confined to his home in the village eight hours' drive from Beijing and subjected to periodic beatings and other abuse, activists say.

While Bale's visit focuses new attention on Chen's case, CNN's role raises questions about activism and advocacy among reporters, said David Bandurski, editor of the China Media Project website at the University of Hong Kong.

"It made me instantly uncomfortable, wondering how it all came together. It raises questions about where the lines are drawn," Bandurski said.

The incident also drew strong interest ? most of it highly positive ? on social networking sites such as Twitter and its Chinese equivalent, Weibo.

Having their star's name pinging across the Internet in connection with such a politically sensitive subject puts promoters of "The Flowers of War" in a bind. The film opens in China on Friday and next week in the United States.

Directed by the renowned Zhang Yimou, it is also the most expensive Chinese movie ever made, at $94 million, some of which came from the state-owned Bank of China.

The movie centers on the 1937 sacking of the eastern city of Nanjing, a central event in China's pre-revolutionary "century of humiliation" and has been described by some critics as hewing to official propaganda portraying Chinese as heroic victims and Japanese as one-dimensional cartoon villains.

While China has the world's third-largest film industry ? both in box office and output ? it has made relatively little global impact. Story lines are often heavily influenced by the ruling Communist Party, whose culture commissars must approve scripts and have final say over whether a film gets released.

Amy Winehouse will be remembered on Sunday at the "VH1 Divas concert. Florence Welch of Florence and the Machine, Wanda Jackson, and Sharon Jones & the Dap-Kings will all take the stage to honor the late singer. The tribute will be introduced by Nas.

Jackson and Welch will perform Winehouse's "Back to Black," while Sharon Jones & the Dap-Kings will take the stage with "You Know I'm No Good." The Dap-Kings played on the singer's Back to Black album. Nas and Winehouse worked together on the track "Like Smoke," which appears on her posthumous album Lioness: Hidden Treasures.

Mary J. Blige, Kelly Clarkson, Jennifer Hudson, Jill Scott, Florence and the Machine, and Jessie J will participate in the star-studded lineup for the long-running concert event, which airs Monday at 9 p.m. ET/PT on VH1.

This year, VH1 is paying tribute to prominent birthplaces of soul music, including Chicago, Detroit, London, Memphis and Philadelphia. The divas are expected to pay homage to these cities and the genre with their own soulful tracks as well as some of soul music's classic tunes onstage at New York's Hammerstein Ballroom.

And the celebration is not exclusive to women. The Roots have been confirmed as the event's house band, and ?uestlove is set to pull double duty during the concert as musical director. Boyz II Men and Travie McCoy will also perform.

Bruno Mars, Russell Brand and Tony Bennett paid tribute to Amy Winehouse at the VMAs back in August. Mars performed Winehouse's cover of the Zutons' "Valerie," while Bennett was on hand to present footage of their recording session for his album Duets II.

"This is not just another London chancer, not just another person milling about waiting to be famous," Brand recalled of seeing Winehouse perform during the tribute. "What is this incredible sound? This timeless sound like a roar from the guts of humanity? The kind of voice that Billie Holiday sung with, the kind of voice that Ella Fitzgerald sung with."

Sir Isaac Newton's notes get a digital makeover, coming to a browser near you

It isn't a rarity for the folks at the University of Cambridge to introduce us to some of their digital findings, and on this occasion they are delivering 4,000 of Newton's manuscripts right to your virtual door. These gems are part of an abundant collection of over 12,000 handwritten notes and hardcovers that the University holds under possession -- the plan is to make the entire selection digitally available "over the next few months." Amongst the scanned documents, you'll be able to find a plethora of his genius scribbles stamped on books that were used during his theory process, some of which are: Trinity College Notebook, Waste Book and the famed Principia Mathematica. Who said an OS would be Newton's only way through a mainframe?

(AP Photo/Bradley C Bower)

(AP) ? As soon as he walked into the Penn State locker room, Mike McQueary heard running water and rhythmic, slapping sounds of "skin on skin." He looked in a mirror and saw a naked Jerry Sandusky, the former assistant coach, holding a young boy by the waist from behind, up against the wall in the campus shower.

"I just saw Coach Sandusky in the showers with a boy and what I saw was wrong and sexual," McQueary recalled telling his father that night in 2002. He repeated it the next morning to coach Joe Paterno, who slumped deep into his chair at his kitchen table.

"He said, 'I'm sorry you had to see that,'" McQueary said.

McQueary's testimony Friday at a preliminary hearing for two Penn State officials accused of covering up the story was the most detailed, public account yet of the child sex abuse allegations that have upended the university's football program and the entire central Pennsylvania campus. Paterno and the university president have lost their jobs, and officials Tim Curley and Gary Schultz are accused of lying to a grand jury about what McQueary told them.

A Pennsylvania judge on Friday held Curley, the university's athletic director, and Schultz, a retired senior vice president, for trial after the daylong hearing.

Curley said that McQueary never relayed the seriousness of what he saw, and said he was only told that Sandusky was "horsing around" with a boy but that his conduct wasn't sexual.

He said he told the university president about the episode and the top official at a children's charity that Sandusky founded, but never told university police. "I didn't see any reason because I didn't think at the time it was a crime," he told the grand jury, according to testimony read into the record on Friday.

Curley, Schultz and Paterno have been criticized for never telling police about the 2002 charges. Prosecutors say Sandusky continued to abuse boys for six more years. Sandusky has denied having inappropriate sexual contact with boys.

In about two hours on the witness stand, McQueary said again and again that what he saw was a sexual act, although he stopped short of saying he was sure that Sandusky, now 67, had raped the boy.

"I believe Jerry was sexually molesting him and having some type of sexual intercourse with him," McQueary said on Friday. He said later he "can't say 100 percent" that Sandusky and the boy were having intercourse because he was seeing Sandusky from behind.

He said after talking to his father, he went over to Paterno's home the next morning and said that what he had seen "was way over the lines, it was extremely sexual in nature." He said he would not have used words like sodomy or intercourse with Paterno; he did not get into that much detail out of respect for the coach, he said.

Paterno told the grand jury that McQueary said he saw Sandusky doing something of a "sexual nature" with the youngster but that he didn't press for details.

"I didn't push Mike ... because he was very upset," Paterno said. "I knew Mike was upset, and I knew some kind of inappropriate action was being taken by Jerry Sandusky with a youngster."

Paterno told McQueary he would talk to others about what he'd reported.

McQueary said he met nine or 10 days later with Curley and Schultz and told them he'd seen Sandusky and a boy, both naked, in the shower after hearing skin-on-skin slapping sounds.

"I would have described that it was extremely sexual and I thought that some kind of intercourse was going on," said McQueary.

McQueary said he was left with the impression both men took his report seriously. When asked why he didn't go to police, he referenced Schultz's position as a vice president at the university who had overseen the campus police

"I thought I was talking to the head of the police, to be frank with you," he said. "In my mind it was like speaking to a (district attorney). It was someone who police reported to and would know what to do with it."

The square-jawed, red-haired assistant coach spoke in a steady voice in his first public account of the alleged abuse, sometimes turning his seat and leaning toward defense lawyers to answer questions. His voice rose a few times and he blushed once when describing the sexual encounter in the shower.

Defense lawyers for Curley and Schultz argued that a perjury charge should not be based solely on a person's testimony under oath contradicting someone else's testimony. The defense said uncorroborated testimony from McQueary is not enough and sought to pick apart the ways he described the shower scene differently to different people.

The defense noted that McQueary admitted changing his description of the shower encounter when speaking with Paterno ? enough so that the coach didn't believe a crime had occurred.

McQueary said he had stopped by a campus football locker room to drop off a pair of sneakers in the spring of 2002 when he saw Sandusky with the boy, who he estimated was 10 or 12 years old.

McQueary, 37, said he has never described what he saw as anal rape or anal intercourse and couldn't see Sandusky's genitals, but that "it was very clear that it looked like there was intercourse going on."

In its report last month, the grand jury summarized McQueary's testimony as saying he "saw a naked boy ... with his hands up against the wall, being subjected to anal intercourse by a naked Sandusky."

McQueary said he peeked into the shower three times ? the first via a mirror, the other two times directly. The last time he looked in, Sandusky and the boy had separated, he said. He said he didn't say anything, but "I know they saw me. They looked directly in my eye, both of them."

McQueary said the entire encounter ? from when he first entered the locker room to when he retreated to his office ? lasted about 45 seconds.

Curley told the grand jury that he couldn't recall his specific conversation with McQueary, but McQueary never reported seeing anal intercourse or other sexual conduct. He said he spoke to Sandusky about it, who first denied having been in the shower with a boy, but later changed his story.

Schultz said he remembered McQueary and Paterno describing what the younger coach saw only in a very general way.

"I had the impression it was inappropriate," Schultz told the grand jury. "I had the feeling it was some kind of wrestling activity and maybe Jerry might have grabbed a young boy's genitals."

Under cross-examination, McQueary said he considered what he saw a crime but didn't call police because "it was delicate in nature."

"I tried to use my best judgment," he said. "I was sure the act was over." He said he never tried to find the boy.

Paterno, Schultz and Curley didn't testify, but District Judge William C. Wenner read their grand jury testimony from January at the Dauphin County hearing.

Curley's attorney, Caroline Roberto, said prosecutors "will never be able to reach their burden of proof at a trial."

Schultz's attorney, Tom Farrell, predicted his client would be acquitted.

He also took a shot at Paterno, saying, "I'm an Italian from Brooklyn, and he may not have called the police but he may have done what I would have done, which is get the boys in the car with a few baseball bats and crowbars and take it to the fellow."

Sandusky says he is innocent of 52 criminal charges stemming from what authorities say were sexual assaults over 12 years on 10 boys in his home, on Penn State property and elsewhere.

Curley, 57, was placed on leave by the university after his arrest. Schultz, 62, returned to retirement after spending about four decades at the school, most recently as senior vice president for business and finance, and treasurer.

Uncle of severely obese Ohio boy granted temporary custody (Reuters)

CLEVELAND (Reuters) ? An Ohio judge ruled on Wednesday that a nine-year-old boy removed from his mother's house after his weight topped 200 pounds should be transferred from foster care into the custody of his uncle.

Lawyers for the boy, taken from his mother in October after social workers became aware of health issues stemming from his severe obesity, said the move to Columbus from the Cleveland area will be timed to coincide with the start of the new school semester.

The boy, whose weight has now dropped to 192 pounds, was put under protective supervision in October after he was diagnosed with sleep apnea that requires him to wear a breathing machine to sleep.

John Lawson, the court-appointed attorney who represents the boy, told Reuters the decision would be a good birthday present for the boy, who turned nine-years old this week.

"I'm sure he will be happy," he said. "The resolution today is in everyone's best interest."

Report: 'Teen Mom' Amber violated probation

Madison County Sheriff Dept / AP

By Anna Chan

Seems "Teen Mom" star Amber Portwood just can't stay out of trouble.

Ever since MTV showed the young mother slapping and punching baby daddy and then-boyfriend Gary Shirley in season two of the popular docuseries, Portwood has had some serious legal (and personal)?issues. Among them: child-custody issues, alleged attempted suicide, rehab and of course, the domestic violence charges for the incident with her ex.

After pleading guilty in June to two counts of felony domestic battery, the judge suspended Portwood's two-year jail sentence and?put her on two years of probation.

But it sounds like Portwood hasn't been good while on probation. TMZ reports that her probation officer is claiming that the reality TV personality has violated her terms by?failing to pay probation fees,?not setting up a college fund for daughter Leah, not obtaining her GED and not behaving "well in society."

Our pals over at E! Online also got their hands on the probation violation report. Among the list of offenses, it is noted in the report that Portwood "took substantial steps to comission the criminal offense(s) of Battery and Public Intoxication." (According to TMZ,?Portwood had too much to drink at a restaurant and hit someone in November.)

Portwood is due back in court on Jan. 13 and could do time if the judge revokes her probation.

Is jail the wake-up call that Amber needs? Share your thoughts on our Facebook page.

Climate change may do in some rattlesnakes

As the Earth's climate changes over the next century, rattlesnakes will have to adapt as much as 1,000 times more quickly than they have in the past to find habitats that they can tolerate.

Some species may be flexible enough to handle the rapidly changing conditions. But many will be unable to slither away fast enough to survive. And the same is likely true for other kinds of creatures, including mammals and other reptiles.

NEWS: Giant Snake Preyed on Baby Dinosaurs

"I'm not sure how species will be able to follow the climate so quickly," said Michelle Lawing, a paleobiologist at Indiana University in Bloomington. "In some cases, it might be better for conservationists to move them or create managed corridors where they could be assisted to better, more suitable habitats."

"Even when we make a big effort, the world will still look very different," Lawing added. "We're going to have different combinations of species in different places that we've never seen before."

To predict where animals might be able to live in the coming decades, plenty of studies have taken into account the physical traits of various species and how those traits might limit their future ranges.

To add more context to these kinds of projections, Lawing and colleague David Polly looked to the past to see how rattlesnakes have adapted to previous climate shifts. They chose to study rattlesnakes because these reptiles have lived and moved throughout North America for a long time.

For the first part of the study, the researchers used evidence from fossils and elsewhere to create maps of the ranges of 11 rattlesnake species at 4,000-year intervals over the past 320,000 years. Then, they analyzed all sorts of details about each era's climate conditions, including things such as mean annual temperature and maximum temperature of the warmest quarter of the year. That allowed them to see how temperature and precipitation has affected the suitable ranges of the snakes over the millennia.

In the past, rattlesnakes have responded to changes in climate by moving to new places. Those geographic movements happen 100 to 1,000 times faster than the animals can adapt to physically. In the face of major climatic changes, in other words, evolution is not an option. And the snakes won't be able to move fast enough to get to a new, more habitable place.

The researchers used accepted climate projections from the Intergovernmental Panel on Climate Change to look at how climate changes might affect rattlesnakes through the year 2100.

NEWS: World's Largest Snake Ate Prehistoric Croc

Their results, published in the journal PLoS One, showed that rattlesnakes are going to have to move an average of between 100 and 1,000 times more quickly than they have over the last 300 millennia to reach acceptable places for them to survive. And that's without threats from predators, competitors, parasites, human developments and other obstacles.

"Based on what they've been doing over the past 320,000 years, they probably cannot adapt that quickly in 90 years to different climate tolerances," Lawing said. "They will have to physically move."

Even though rattlesnakes are often vilified, they play important roles in the ecosystems where they live, said Jesse Meik, an evolutionary biologist at the University of Texas, Arlington.

The new study adds insight into what the future holds for these and many other animals that are sensitive to changes in climate, he added. Some species may be able to physically adapt, but some will likely need to shift their home ranges to avoid extinction, and that might not always be possible.

"This study is special in that it takes data from the past and present ? and not just the present ? to make inferences about the future," Meik said. "This is an important development given that inferences about the future are by definition clouded by uncertainty."

"We can probably expect this type of result from all kinds of groups," he added. "I would say that it is not surprising that the results indicate that climate change will happen too quickly for rattlesnakes to deal with, given the magnitude of predicted climate change."
