Sudan frees South Sudan's oil tankers; row continues (Reuters)

KHARTOUM/JUBA (Reuters) ? Sudan has released four tankers loaded with South Sudanese oil in an effort to defuse a row over export transit fees, but southern officials said the move was not enough to reverse their decision to shut off crude supplies.

South Sudan seceded in July under a 2005 peace agreement that ended decades of civil war with Khartoum but the two sides have yet to resolve a long list of disputes. Disentangling the oil industries both depend upon is at the top of the agenda.

The landlocked new nation took control of about three quarters of the unified country's roughly 500,000 barrels a day in oil output, but it needs to export its crude through northern pipelines to the Red Sea port of Port Sudan.

Both sides have been unable to agree on a transit fee, prompting Khartoum to seize part of Juba's exports arriving at the port. In response, South Sudan shut down its oil production last week.

The ships that have been released were already loaded and Sudan had held them from sailing. Separately, Sudan has sold off at least one tanker of crude seized from the South and has offered two other cargoes.

In addition to the three, at least seven tankers are still waiting at the port to lift December and January cargoes, racking up demurrage costs of $20,000-$22,000 per day, traders and shipbrokers said.

Sudan's Oil Minister Awad al-Jaz said Khartoum had released the vessels held at Port Sudan in an effort to ease the tensions and pave the way for a deal, but that South Sudan had showed no sign of reversing its decision to shut off its output.

"We don't have any positive response from the other side," he told reporters at an oil industry conference in the Sudanese capital. "We're still open to cooperation but the other side has refused."

Jaz's southern counterpart Stephen Dhieu Dau confirmed four ships carrying 3.5 million barrels of crude for buyers Vitol and Sinopec had been released, but said ships were still waiting to load another 5.4 million barrels of southern crude.

"The ships are waiting," Dau said. "If they want to negotiate in good faith with us they should allow us to come and lift it."

Trading giant Vitol chartered two of the released tankers, an industry source familiar with the matter told Reuters, adding the two ships were carrying 1.6 million barrels of oil in total.

South Sudan government spokesman Barnaba Marial Benjamin said four more ships were still waiting to load at Port Sudan.

He also said the country was pushing ahead with plans to build two or three refineries and had signed a memorandum of understanding with a U.S. company as part of that.

"We have already signed with a major American company and they will start building as soon as possible and complete in four months," Benjamin told Reuters.

"It will start with 6,000 barrels and ramp up to a maximum of around 110,000 barrels per day by the end of the year."

LONG LIST OF DISPUTES

Analysts expect no quick breakthrough in the oil talks because the two countries' positions have remained far apart.

Khartoum is demanding $1 billion in rear payments and has said it wants $36 a barrel as a transit fee -- a demand that exceeds international norms by more than 10 times, according to some industry analysts.

Sudan also wants assistance with some of its $38 billion in external debt as it struggles to overcome a severe economic crisis exacerbated by the loss of oil revenues. Oil used to make up 90 percent of Sudan's exports.

Sudan's oil minister Jaz blamed Juba for obstructing progress toward a deal, saying South Sudanese officials had refused to sign an African Union-brokered agreement that would have opened the way to defusing the row over the weekend.

"Sudan agreed to sign that. Unfortunately the other side refused to sign," he said.

Senior officials from both countries have also said they want to tie the oil issue into a deal that addresses violence on both sides of the poorly-marked border and finds a solution for the disputed border region of Abyei.

Abyei, rich in fertile grazing land, is a source of tension between north and south. Khartoum seized Abyei in May after an attack on a convoy of northern troops and U.N. peacekeepers that the world body blamed on southern forces.

South Sudanese officials have since said they would offer Khartoum oil at discounted prices and financial help if it gave up its claim to Abyei.

Oil provides about 98 percent of South Sudan's income and is vital to the impoverished country as it tries to develop infrastructure and institutions devastated by a war that killed an estimated 2 million people.

China is the biggest buyer of oil from Sudan and South Sudan -- it got about 5 percent of its oil from the two last year -- and the biggest investor in South Sudan's oilfields.

Wendy's CEO: Our wounds were 'self-inflicted' (AP)

NEW YORK ? Wendy's new CEO on Monday called the dour results of the past few years "self-inflicted wounds" and vowed to do better, laying out plans that included hiring top-tier workers and reclaiming market share from higher-end competitors like Five Guys and Smashburger.

Emil Brolick, the CEO since September, told investors on Monday that he was intent on winning back customers, jaded by a stale menu and inconsistent service, as well as investors, who have grown weary of "a little bit of overpromising and under-delivering."

And rather than blaming the struggling economy for the revenue declines and quarterly losses of the past few years, Brolick said that the company's problems were its own fault. Though Wendy's Co. had carved out a niche in the restaurant business as fast food for grownups, it had lost its way in recent years.

"These are not DNA issues," said Brolick, who also worked at Wendy's during more halcyon days of the late '80s and early '90s. "These are issues we caused, and any time you have self-inflicted wounds, you can correct self-inflicted wounds."

Brolick said he was intent on taking back lost market share from the likes of fast-casual competitors like Panera and Chipotle, by offering food that was just as good but at a lower price. The company has revamped its menu and is remodeling stores. It sold Arby's, which had been a drag on earnings, over the summer. And it's now intent on hiring "five star" employees in line with those at the fast-casual chains, Brolick said.

"Those folks at the bottom corner, there's a job waiting for them at our competitors," said Brolick, who has also hired a new general counsel at the Ohio headquarters and is adding a chief marketing officer and chief people officer.

Brolick, who was most recently a top executive at Yum Brands Inc., said he's bringing all Wendy's locations up to consistent standards for friendliness and cleanliness, rather than the current, unpredictable state of "one there is really, really good but this one over here isn't quite what it needs to be."

"We've made great progress in getting rid of those F restaurants and getting more A's and B's, but we're still in that territory," Brolick said.

Like many fast-food chains, Wendy's is taking some of its turnaround plans from McDonald's book. The much-larger burger chain has done well throughout the recession and its aftermath by trying to reinvent itself as a hip, healthy place. New offerings like fancy coffee drinks and smoothies, and remodeled restaurants with wireless access, have brought in customers who previously might have shunned it. At the same time, McDonald's has kept prices at fast-food levels so that its reliable base of cash-strapped customers doesn't flee for cheaper hamburgers at the gas stations.

McDonald's has run into some resistance from franchisees who sometimes have to foot the bill for the changes. Brolick said Wendy's franchisees were "very, very supportive "of the plans. He acknowledged that "we are going to spend a lot of their money," then added later: "The economics have to work. They do work."

Brolick's message to investors, who gathered at the Nasdaq building in New York, came a few hours after the company reported mixed results for the fourth quarter.

Wendy's income from continuing operations fell 30 percent to $4.3 million in the last three months of the year, down from $6.1 million in the fourth quarter of 2010. That year-ago number strips out the effect of Arby's, which Wendy's sold this summer to a private-equity firm.

Wendy's marriage with Arby's was short-lived. It began in the depths of the financial crisis in fall 2008, and ended when managers said they wanted to focus on the Wendy's brand alone. Wendy's said Monday it spent nearly $46 million over 2011 to break up with Arby's, including severance costs for some employees and retention bonuses for others.

Revenue rose 5.6 percent to $615 million, narrowly beating the $613 million predicted by analysts. The chain credited more customers visiting and spending more when they did, including on the revamped Dave's Hot 'N Juicy cheeseburger. Higher prices also helped.

Revenue at restaurants open at least a year climbed 4.4 percent in North America, the highest number in nearly 8 years, according to the company. That's a key measure of a company's health because it strips out the effect of newly opened or closed stores.

On a per-share basis, adjusted earnings were 4 cents, in line with the expectations of analysts polled by FactSet. That number excluded one-time charges like the costs for selling Arby's and writing down the value of some of its assets. With those charges, per-share earnings would have been 1 cent per share.

Last week, Barclays Capital analyst Jeffrey Bernstein spoke favorably of the changes at Wendy's, saying the company has greater potential for long-term earnings growth than competitors but is trading at a comparative discount. Sanford C. Bernstein analyst Sara Senatore said Monday that though revenue numbers beat her expectations, some of the earnings predictions that the company made for 2012 were below Wall Street's expectations.

Wendy's shares fell 20 cents, or 3.8 percent, to close at $5.01.

Governor's office: Stop state spending on ex-CEO's legal fees ...

Former Kansas Bioscience Authority CEO Tom Thornton knew he was under criminal investigation and asked the agency for personal legal representation at least two weeks before he electronically shredded documents on his laptop computer, according to a letter obtained by The Eagle.

In a letter dated April 7, Thornton asked the KBA board to pay for his personal legal fees and indicated that he had retained James Eisenbrandt, a Prairie Village lawyer who specializes in white-collar criminal defense. Eisenbrandt is best known in Wichita for representing former Westar Energy CEO David Witting on federal charges of looting the utility.

The KBA, a state-funded agency, agreed to pay Thornton?s legal bills and has so far spent $53,671 on his defense, including about $1,800 to fly two lawyers to meet with Thornton in Ohio, where he is now employed in the Innovations division at the Cleveland Clinic.

The KBA has spent an additional $10,197 on legal representation for former KBA chief financial officer, Janice Katterhenry, who worked closely with Thornton.

Gov. Sam Brownback?s administration weighed in Saturday on Thornton?s legal fees and questioned why taxpayers should have to foot the bill for Thornton?s personal legal expenses.

?As good stewards of Kansas taxpayer monies, the KBA board should suspend all payments to Thornton?s attorneys and then pursue all legal means possible to seek a maximum recovery of taxpayer dollars from him," said an e-mail statement from Sherriene Jones-Sontag, the governor?s spokeswoman.

?I just think most Kansas taxpayers are going to find these expenses repulsive,? said Sen. Susan Wagle, R-Wichita, who has led legislative efforts to investigate the KBA since last year. ?It?s a colossal waste of taxpayer funds. The salary he earned, at $1.8 million (over 4 1/2 years) should have covered his legal expenses.?

Wagle also said the expenses paid so far could be just the beginning. ?There haven?t even been any charges filed yet,? she said.

Audit of the KBA

Billing records indicate that much of the expense revolved around Thornton?s and Katterhenry?s participation in a lengthy audit that was conducted by the national firm BKD LLC. The $960,000 audit, 900 pages of reports and supporting documentation, was released by the KBA on Monday.

The report identified few problems with the KBA?s handling of its primary duty, investing state dollars in bioscience companies.

But it faulted Thornton for destroying documents, misusing public funds for personal expenses, and creating an uncomfortable work environment by having an office romantic relationship with a woman he hired and later married.

Thornton has not returned messages seeking comment left on his office voicemail, e-mail and with a secretary at the Cleveland Clinic during the past week.

David Vranicar, who took over from Thornton as the acting chief executive of the authority, said the agency?s bylaws require it to pay for legal fees for current and former officers who are under investigation.

The former officers can be required to repay the authority for their legal expenses if the KBA board determines they acted in bad faith, against the interests of the authority, or had reason to believe their activities were illegal, the bylaws say.

Thornton?s letter and the resulting legal bills were obtained by The Eagle through a request filed under the Kansas Open Records Act.

Thornton?s letter

In the letter, Thornton wrote: ?I reasonably believe that in my capacity as an officer of the KBA, I am the target of a criminal investigation being undertaken by the district attorney of Johnson County. I have no reasonable cause to believe that any of my conduct as an officer of KBA has been unlawful. This will request that the KBA indemnify me in connection with such investigation and any resulting criminal proceedings which may be brought against me.?

On April 5, two days before Thornton sent his letter to then-KBA board president John Carlin, media reports had revealed that the district attorney was looking into allegations of wrongdoing at the authority. On April 6, the KBA confirmed that prosecutors had served subpoenas seeking to interview some of its employees.

When Thornton?s letter was filed on April 7, he said he had already hired a lawyer to represent him personally.

?I have retained James Eisenbrandt of the law firm of Berkowitz Oliver Williams Shaw and Eisenbrandt, LLP, to represent me in conjunction with the investigation and any resulting criminal proceedings,? the letter said.

When Thornton resigned from the authority on April 13, seven days after filing his letter, he retained possession of his work computer.

Files deleted

When he returned it on April 25, ?Forensic analysis of Thornton?s KBA-owned computer indicated that information had been removed from the computer, essentially all of the user-created content had been deleted, and that the free space had been wiped making the recovery of deleted items impossible,? the BKD report said. Programs to delete and electronically shred documents had been run on April 21, 22 and 23, the audit said.

Thornton admitted in an August interview with the auditors that he had wiped the computer.

?Mr. Thornton indicated that he did so because he was concerned that representatives of the State of Kansas would be involved in the review of the computer?s content and would possibly be politically motivated to inappropriately construe or use its contents,? the audit said. ?Mr. Thornton indicated that he had used the KBA-owned computer for his personal use and that it contained personal financial and tax information, family photos and other information of a personal nature, some of which would be embarrassing if made public.?

Auditors found some file extensions and data consistent with pornography, the audit said.

The audit said Eisenbrandt told interviewers that he was unaware that the computer files had been wiped until they brought it to his attention.

$475 an hour

The law firm?s billings show that the KBA is paying Eisenbrandt $475 an hour to represent Thornton.

The authority is paying $300 an hour for another partner in the firm, Christina DiGirolamo, $245 an hour for associate attorney Shahzad Naseem and $170 an hour for paralegal Leigh Oliver.

The KBA is also reimbursing the law firm?s expenses.

The biggest expense so far was $1,845 ? including two $845 plane tickets ? for Eisenbrandt and DiGirolamo to travel to Cleveland to meet with Thornton.

Sen. Chris Steineger, R-Kansas City, said he thinks the legal bills are excessive and questioned why Thornton was allowed to pick such expensive representation for himself.

?If we (the state) have to pay his legal bills and our own legal bills to chase him, we could end up spending $1,000 an hour or some crazy amount,? he said. ?It?s like a poison pill, or a disincentive to try to even pursue legal action against Tom Thornton.?

Audit cost under fire

Friday, before the legal bills were released, three legislative leaders from both sides of the aisle criticized the cost of the audit and said the time has come to move on.

"The problems seem to be with the head guy who?s now gone," said House Speaker Mike O?Neal, R-Hutchinson.

Senate Minority Leader Anthony Hensley, D-Topeka, said the audit showed there wasn?t really any conflict of interest and that investments were solid.

"It was a $960,000 witch-hunt, essentially, to uncover, what, was it 4,800 bucks total?" he said. The $4,800 refers to money that Thornton reimbursed the state about two weeks ago after auditors found he had used state money to buy artwork for his home and a plane ticket to Cleveland for a job interview.

House Minority Leader Paul Davis, D-Lawrence, said the audit was requested and its scope largely directed by Gov. Sam Brownback?s administration.

Davis said scrubbing the computer, sex in the office and using public money for non-business travel and art was clearly wrong. But he suggested some lawmakers seem to be hunting for more without significant evidence.

"This sort of reminds me of back to the Iraq War," he said. "We were looking for the weapons of mass destruction. And where are the weapons of mass destruction? We found some things that are disturbing and we found some good guidance for the organization going forward. But I think what this comes back to ... is the governor?s desire to have full control over the Kansas Bioscience Authority."

After learning of Thornton?s legal arrangements late Friday, Davis said he believes that Thornton is ?certainly entitled to representation in respect to his actions as an employee of the KBA.?

And he said he expects the authority will seek to recover the money if Thornton is convicted of a crime.

However, he added, ?the attorney fees seem to be a little excessive in my opinion; $475 an hour is far above what the typical Kansas attorney is charging. That concerns me a little bit.?

Hundreds arrested at Occupy Oakland protest

Story updated 6:00 a.m. ET: A U.S. flag was burned by a group of protestors inside City Hall, according to City Council President Larry Reid. City officials also said three police officers and one protester were injured during Saturday's events.

Sgt. Christopher Bolton of the Oakland Police Department told msnbc.com that the number arrested was likely between 200 and 300. "We are still processing the arrests," he said. He was speaking after the release of a statement on the Oakland City website that put the number of arrests at 200. "That figure is probably on the low side and we don't have a confirmed total yet," said. Sgt Bolton. In the statement, released in a PDF file format, Oakland Mayor Jean Quan said: "Once again, a violent splinter group of the Occupy Movement is engaging in violent actions against Oakland. The Bay Area Occupy Movement has got to stop using Oakland as their playground." The statement also said there were reports of damage to exhibits inside City Hall during the protest.

OAKLAND -- Police arrested about 300?people Saturday?as Occupy Oakland protesters were thwarted trying?to take over a vacant convention center and?a YMCA but?later broke into City Hall, where they burned a flag taken from?inside.

Police used tear gas and "flash" grenades in the afternoon against 2,000 protesters who tried to tear down fences around?the vacant Henry Kaiser Convention Center, where they hoped to establish?a new camp. Police said some demonstrators started throwing objects at officers. There were at least 19 arrests in the afternoon.


After 6 p.m. (9 p.m. ET), police?in riot gear declared a group of protesters gathered near the YMCA under mass arrest?for failing to disperse, according to local media reports and livestreams. Police said about 100 demonstrators were?arrested at the YMCA.

Several protesters at? the YMCA appeared to be put hard to the ground as police moved in and at least one protester had blood on his face.

Protesters chanted, "Let us disperse," but instead were taken one by one for police processing.

Some protesters claimed they were trying to flee police by running through the YMCA rather than take over the building.

Later in the evening, about 100 police officers surrounded City Hall while others?swept the inside of the building.

Police arrived after?protesters had broken into City Hall, stole an American flag from the council chamber and set it ablaze, the Oakland?Tribune reported. Officers stomped out the fire.

Earlier, protesters met at Frank Ogawa Plaza around noon and marched toward the convention center in hopes of making it their new meeting place and social center, NBCBayArea.com reported.

Oakland officials said about 250 people were in the group when the protest started but the crowd grew to about 2,000.

Earlier during the rally one of the organizers, Shake Anderson, said, "We are here to protect each other and to be civil disobedient. ... We're doing it to change the world, not just today but every day."

The protesters were walking through Laney College around 2:30 p.m. Some people were wearing bandanas over their mouths and others were holding signs saying, "We are the 99%." A marching band dressed in pink and black tutus and neon pick tights also was in the crowd.

Officer Jeff Thomason said police started making arrests when some in the crowd started throwing objects at them during the afternoon rally. Three officers were injured, police said, but did not elaborate.

@OaklandPoliceCA tweeted around 3 p.m., "Area of Oakland Museum and Kaiser Center severely impacted. Persons cutting and tearing fences for entry. Bottles and objects thrown at OPD."

Once they reached the center, organizers planned to kick off a two-day "Oakland Rise-up Festival" to celebrate the establishment of the movement's new space.

Occupy Oakland spokesman Leo Ritz-Bar said the action would signal "a new direction for the Occupy movement: putting vacant buildings at the service of the community."

He also warned that protesters could retaliate against any repressive police action by blocking the Oakland International Airport, occupying City Hall or shutting down the Port of Oakland.

City officials said that while they are "committed to facilitating peaceful forms of expression and free speech, police would be prepared to arrest those who break the law.

"The city of Oakland will not be bullied by threats of violence or illegal activity," city administrator Deanna Santana said in a statement issued Friday.

Oil gives up gains after US GDP lags estimates (AP)

NEW YORK ? Oil prices are flat with a report showed the U.S. economy grew at a slightly slower than expected pace in the fourth quarter.

The Commerce Department said Friday that the economy grew at a modest 2.8 percent in the final three months of last year. While that is the fastest growth in 2011, economists expected 3 percent growth.

Benchmark crude for March delivery was down 5 cents at $99.65 in early trading on the New York Mercantile Exchange. The price had risen above $100 a barrel earlier as the market continues to await the outcome of gamesmanship between Iran and Western nations.

Brent crude for March delivery rose 55 cents to $111.40 on the ICE Futures Exchange in London.

No doubt 2 Chainz is the hottest underground rapper in the streets right now, so when he threw a nod to rap legend Too $hort on Rick Ross' "F--- Em," it proved that the ATL spitter's hip-hop ties were deep-rooted. "Dad wasn't around; my father figure was Too $hort," 2 Chainz spit when he appeared on Rozay's Rich Forever mixtape.

So when Chainz and Short Dog appeared on Wednesday's "RapFix Live," they shared quite a moment. It was $hort's 1988 album Life Is ... Too $hort that provided 2 Chainz with his earliest musical memories after he sent someone much older than him to the store to buy the explicit CD LP for him. "I remember being in the neighborhood and all the other kids' parents thought I was bad because I was tryin' to get them to get on that," 2 Chainz said.

2 Chainz went on to praise $hort for his beef-free career as well as his way with the ladies. "I can only imagine why $hort has never had beef with nobody," 2 Chainz told "RapFix" host Sway Calloway. "He's a straight-up businessman. He got a savvy and it is about the women. And at the end of the day, it's about getting your money."

Getting money is something 2 Chainz knows plenty about. His current single, "Spend It," is a lyrical celebration of life's excesses. Industry insiders expect Chainz to go on to cash even bigger checks once he signs with one of the major labels that have been pursuing him. "I'm coming up to New York to have a few finalized meetings," 2 Chainz said about his plans for next week.

Chainz is also headlining his first major NYC show at SOB's on Monday and will stop by "RapFix Live" next Wednesday.

US Army chief 'comfortable' with cuts to force

The U.S. Army chief said he is "comfortable" with plans to shrink the size of his force as the Pentagon prepares to slash eight brigades as part of defense cuts worth $260 billion over five years.

General Raymond Odierno, chief of staff of the Army, told Reuters: "We're now out of Iraq, we're reducing our commitment in Afghanistan, so we can now bring the size of the Army down. And I feel comfortable with how we're going to do that."

He was speaking on Wednesday, as the Pentagon prepared to unveil a smaller Army and the withdrawal of two brigade combat teams from Europe. Those fixed brigades will be replaced by rotational units.

The Pentagon will preview President Barack Obama's budget proposal for the Pentagon on Thursday.

It is expected to cut $260 billion in projected defense spending over the next five years and favor services like the Navy and the Air Force over the Army and Marines.

"It's more about the timeline we bring it down on, and I'm satisfied with that timeline,? Odierno said.

A U.S. official confirmed media reports that the Pentagon plans to slash eight Army brigades and reduce the overall force to as few as 490,000 over the next decade from around 565,000.

But Obama and Defense Secretary Leon Panetta have said they will not hollow-out the force with the kind of cuts the military endured in the wake of the Vietnam war.

Indeed, U.S. officials have pointed to concerns about China's military buildup and North Korea's nuclear advances as they explain plans to focus more on the Asia-Pacific region.

Odierno, fresh from a trip to Asia, acknowledged the need for naval and air assets in any military strategy for the Pacific.

But he stressed that the Army will keep playing an important role in the region, and pointed to the 19,160 soldiers deployed in South Korea as a deterrent against the North.

Indeed, Odierno saw no downsizing of the Army presence in Asia and said it will further supplement its forces with troops who rotate in and out of the region.

"That's what we got to decide: How much rotational presence will we be able to do," Odierno said.

Odierno noted that the Army could play an important diplomatic role engaging with militaries in Asia, given that 22 out of the 28 chiefs of defense in the Pacific are army officers.

Seven out of the world's 10 largest land armies in the world are in the Pacific, he added.

That common army background "will help us to build relationships," he said.

IAEA checks Japan reactors pending safety approval (AP)

OHI, Japan ? A team of International Atomic Energy Agency experts is making its first inspection of a Japanese nuclear power plant that has undergone official "stress tests" required after the Fukushima disaster.

On Thursday, the 10-member IAEA team was inspecting two reactors at the Ohi nuclear power plant in Fukui prefecture in western Japan.

Passing the test is one of several steps needed to restart dozens of idled nuclear plants.

Only four of Japan's 54 reactors are currently operating, so getting some back on line would help Japan avoid a power crunch.

If none get approval, Japan will be without an operating reactor by the end of April.

The stress tests are meant to assess how well the plants could withstand earthquakes, tsunamis and other extreme events.

Dollar falls against euro after Fed statement (AP)

NEW YORK ? The dollar turned lower against the euro Wednesday, erasing gains it made earlier in the day, after the Federal Reserve said that it is unlikely to raise interest rates before late 2014.

Lower interest rates tend to weigh on a currency by reducing the returns investors get from holding it. The central bank has kept interest rates near zero since cutting them during the financial crisis in December 2008. Keeping rates low is a sign that the Fed thinks the economy still needs help in order to recover.

The Fed also forecasted slightly lower growth in 2012 but said the unemployment rate could fall.

The euro rose to $1.3084 in late trading Wednesday from $1.3021 late Tuesday.

The dollar was also lower against most other currencies around the world.

The British pound rose to $1.5643 from $1.5603. The dollar fell to 0.9231 Swiss franc from 0.9286 Swiss franc and to 1.0074 Canadian dollar from 1.0101 Canadian dollar.

But the dollar rose to 77.81 Japanese yen from 77.73 Japanese yen after Japan posted its first annual trade deficit since 1982

HBT: Josh Johnson feels good after bullpen session

Marlins right-hander Josh Johnson made only nine starts last season due to shoulder issues. He?s optimistic that things will be far different in 2012.

According to beat writer?Joe Capozzi of the Palm Beach Post, the 27-year-old ace felt ?good? after throwing a bullpen session (29 pitches) Tuesday for the first time since September. He has been cleared for regular mound work, and should enter spring training late next month with a clean bill of health.

Johnson posted a 2.30 ERA and 186/48 K/BB ratio across 183 2/3 innings in 2010 and owns a superb 2.98 ERA for his career. If all continues to go well, he will start the Miami?s season opener April 4 vs. St. Louis.

(AP) ? The race for the best original song Oscar is a slim one with two songs up for the honor, a first for the Academy Awards.

Sergio Mendes' "Real In Rio" from the animated adventure "Rio" will compete with Bret McKenzie's "Man or Muppet" from "The Muppets," despite having songs from a bevy of all-star musicians like Elton John, Mary J. Blige, will.i.am and Pink in contention for nomination.

Charles Bernstein, the former chairman of the Academy Awards' music branch, says he "personally was surprised" that only two songs are up for the honor.

In the past, the number of nominees for best original song has ranged from three to 14. Only up to five songs are eligible for nomination.

"I personally felt that there may have been more than two that I personally would have championed," he said in an interview after the Oscars nominations were announced Tuesday. "But it is a majority vote situation."

This year, 39 songs were eligible for nomination for best original song, including tracks from Brad Paisley, Robbie Williams, The National, Zooey Deschanel, Zac Brown, Chris Cornell and others.

Members of the music branch can rank songs using 10, 9.5, 9, 8.5, 8, 7.5, 7, 6.5 or 6, and a song must have at least an average score of 8.25 to be nominated. If only one song gets that score, it and the song receiving the next highest score will be the two nominees.

Since two songs were nominated, it could mean that voters were unimpressed with this year's contenders.

"Each person is voting on a subjective impression ... so you'd have to go into the head of each individual voter to kind of know what it was that made them feel that any given song was or wasn't award-worthy," Bernstein said.

Bernstein also stressed that the songs "have to be written for the picture, and the judgment of its quality has a great deal to do with how it functions in the movie as well as how well written it is."

Bernstein, who did vote in the category, wouldn't say how many people voted this year, but did say that the rules for each Academy Award are carefully observed each year. He says the music branch will most likely take a closer look at the requirements for best original song after this year's results.

"It's very likely because there were two this year that the rules committee will probably take another look at it next year and make sure it wants to continue the same rules," he said.

Madonna's "Masterpiece," which won the Golden Globe for best original song and is from her directorial effort "W.E.," was not eligible for an Academy Award because "the song does not occur either in the body of the film, or as the first song at the end of the film," Bernstein said.

Mendes, who shares his nomination with Siedah Garrett and Carlinhos Brown, says "Rio" director Carlos Saldanha delivered the good news to him.

"I don't know much about the voting process really. I'm not an expert in that, but I'm so happy about me being nominated," Mendes said Tuesday afternoon. "I don't really know the criteria, but I can only think about celebrating."

Penn St coach O'Brien: Following Paterno an honor (AP)

FOXBOROUGH, Mass. ? One of Bill O'Brien's first acts as the new Penn State football coach was to mourn the loss of the old one.

O'Brien said former Nittany Lions coach Joe Paterno, who died Sunday, was "an icon in the coaching profession." But he was also more than just a coach, O'Brien said in offering condolences to the Paterno family, current and former Penn State players and the rest of the university community.

"Today they lost a great man, coach, mentor and, in many cases, a father figure, and we extend our deepest sympathies," O'Brien, the New England Patriots offensive coordinator, said in a statement before the AFC championship game against the Baltimore Ravens.

"The Penn State football program is one of college football's iconic programs because it was led by an icon in the coaching profession in Joe Paterno. There are no words to express my respect for him as a man and as a coach."

Paterno died at the age of 85 from complications of lung cancer, two months after he was fired in the wake of sexual abuse allegations against one of his assistant coaches. O'Brien was hired to replace him, but he is finishing out the year with the Patriots as they reached the AFC title game for the second time in his five years with the team.

In his 46 years at Penn State, Paterno won two national championships and 409 games in all ? the most in the history of major college football.

"To be following in his footsteps at Penn State is an honor," O'Brien said "Our families, our football program, our university and all of college football have suffered a great loss, and we will be eternally grateful for coach Paterno's immeasurable contributions."

The Patriots said O'Brien did not address Paterno's death with the team on Sunday, when New England won 23-20 to advance to the Super Bowl. That means Penn State will have to wait another two weeks before O'Brien takes over the job full-time.

"I think Penn State has hired a great young man to be their head coach, someone I'm very fond of," Patriots owner Robert Kraft said in the locker room after the game. "Hopefully if we collect enough draft picks we'll be able to pick his best players."

Receiver Matthew Slater was among the players in Sunday's game offering their condolences to Paterno's family. Several of them did not know Paterno had died.

"The man was a legend and always will be," Slater said. "It's tough to fill the shoes of a legend, but I think that they picked a great coach who's a leader, who's (going to) try to build men with those kids there at Penn State. He's going to do everything he can to help that program on and off the football field, and I think he was a great hire."

But, for now, O'Brien is focused on winning the Super Bowl.

"Billy, right now, the job he's doing under the pressure that he has on his own has been phenomenal," offensive lineman Brian Waters said. "He definitely hasn't slipped one bit; it's been no distraction. You wouldn't even know that he was going to be going to a big-time job somewhere else. He's done a great job, and I expect he's going to be at an even higher level in the next two weeks."

Macy's sues Martha Stewart Living for breach

Macy's Inc is suing Martha Stewart Living Omnimedia Inc, accusing the company of breach of contract for entering into an agreement to sell certain products to J.C. Penney Company Inc.

Macy's says Martha Stewart Living granted it the exclusive right to make and sell certain products under a 2006 agreement, according to a New York state Supreme Court filing Monday.

Macy's is seeking a preliminary injunction stopping Martha Stewart from violating the contract. It also is seeking an order sealing the lawsuit and motion, saying it is prohibited from disclosing certain information.

The court filing does not detail the products in question.

Martha Stewart Living agreed "to grant Macy's the exclusive right to manufacture and sell Martha Stewart branded products in certain exclusive product categories," Robert Micheletto, a partner at Jones Day who represents Macy's, wrote in court papers.

"In direct violation of the terms of the agreement, MSLO recently announced it has entered into an agreement with" J.C. Penney Company Inc to sell Martha Stewart products that fall into Macy's exclusive product categories, the papers claim.

Martha Stewart Living did not immediately return a call for comment. Neither did JC Penney or Macy's.

The case is Macy's Inc. v. Martha Stewart Living Omnimedia, Inc., 650197/2012, New York state Supreme Court.

Rising wealth of Asians straining world fish stock (AP)

MANILA, Philippines ? Rising wealth in Asia and fishing subsidies are among factors driving overexploitation of the world's fish resources, while fish habitat is being destroyed by pollution and climate change, U.N. marine experts said Tuesday.

Up to 32 percent of the world's fish stocks are overexploited, depleted or recovering, they warned. Up to half of the world's mangrove forests and a fifth of coral reefs that are fish spawning grounds have been destroyed.

The U.N. Environment Programme says less-destructive ways of fishing that use more labor and less energy are needed to help restore the health of the world's oceans and coasts.

The agency is leading a five-day conference in Manila of experts and officials from 70 governments.

Jacqueline Alder, head of UNEP's marine, coastal and freshwater office, said the increasing ranks of rich Asians are driving demand for better quality fish that are often not abundant, adding pressure to their supply.

"People don't want to eat the little anchovies anymore when they can eat a nice snapper or grouper ? much nicer fish, shows much more of your wealth," she told reporters.

Alder said booming population, more awareness of health benefits from eating fish, fuel and boat-building subsidies in industrial fisheries, weak management and limited understanding of ecosystems' values are also driving fish overexploitation.

She said subidies should be reduced or eliminated, fishing gears should be less destructive, and the number of boats and fishers reduced. Habitat management should also be strengthened and marine protected areas established.

Fish is the main source of protein for up to 20 percent of the of world's population and some 180 million people are directly or indirectly employed by the fishing industry, she added.

Vincent Sweeney, UNEP's coordinator for the Global Program of Action to prevent marine environment degradation from land-based pollutants, said up to 90 percent of sewage in developing countries is discharged untreated into rivers, lakes and oceans, posing one of the most serious threats to water resources.

Other pollutants from land including nitrogen and phosphorous from fertilizers and detergents result in hypoxia or "dead zones" where too many nutrients cause an undesirable growth of plants that compete with coral reef and other marine life for oxygen.

Jerker Tamelander, head of UNEP's coral reef unit, said healthy coral reefs can produce up to 35 tons of fish per square kilometer each year while there is a catch reduction of 67 tons for every square kilometer of clear-cut mangrove forest.

The global market value of marine and coastal resources and industries is estimated at $3 trillion per year or about 5 percent of the global economy, he said. Non-market value such as climate, water, nutrients and carbon regulation is estimated at $22 trillion a year.

"We've lost a fifth of the world's coral reefs and 60 percent are under direct and immediate threat and climate change plays an additional role in driving reef loss," he said.

Tamelander said the decline in coastal ecosystems' health and productivity can be reversed by shifting to greener and more sustainable strategies, addressing threats and better management that involves all stakeholders.

"The sooner we act, the easier it will be and the longer we wait the harder it will be," he warned.

When you think of Super Bowl Sunday, many images likely come to mind: malty beverages, nachos, high-budget commercials and -- oh, yeah -- football. Even amongst us mobile fanatics, however, cellular coverage rarely crosses the mind. Fortunately, that's not how Big Red rolls. The company has brought three of its LTE cell-on-wheels rigs to Indianapolis in anticipation of the Big Game, which is expected to draw 85,000 attendees. Amongst other things, Lucas Oil Stadium is now wired to the teeth with $69 million in Verizon gear to ensure that all subscribers will be able to tweet along with each touchdown, fumble and botched call -- like the Giants / Packers game, for instance. In addition to the COWs, the equipment includes 400 mobile antennas inside the stadium to carry voice and data, along with 600 WiFi stations to support a total of 28,000 simultaneous connections. The folks at GottaBeMobile have an excellent spread of how all this came together, but if you're more of the visual type, you'll find a quick video after the break.

Ambush of police truck in Syria kills 14 (AP)

BEIRUT ? A string of explosions struck a police truck transporting prisoners in a tense area of northwestern Syria on Saturday, killing at least 14 people, the country's state-run news agency and an opposition group said.

Troops fought intense battles against defectors elsewhere in northern Syria, activists said, leaving "dozens" of people wounded. The 10-month uprising against Syrian President Bashar Assad has turned increasingly militarized and chaotic as more frustrated regime opponents and army defectors arm themselves and fight back against government forces.

SANA news agency blamed the attack on the police truck on "terrorists" and said it occurred on the Idlib-Ariha highway, an area near the Turkish border that has witnessed intense fighting with army defectors recently.

Four bombs that went off in "two phases" hit the truck, and then attackers targeted an ambulance that arrived to assist the wounded, SANA reported.

Six policemen who were accompanying the prisoners were also wounded, some of them in critical condition, it said.

The British-based opposition activist group, the Syrian Observatory for Human Rights, confirmed the incident Saturday and said 15 prisoners were killed.

Rami Abdul-Rahman, director of the group, said the truck was hit by several roadside bombs, but it was not clear who was behind the attack.

There was no immediate claim of responsibility, but members of the so-called Free Syrian Army are known to be active in the area.

A Syria-based activist said the area has several army encampments and is full of roadside bombs planted to target army tanks passing by, adding that the truck carrying prisoners may not have been the intended target.

The activist spoke on condition of anonymity for fear of reprisals.

Abdul-Rahman and other activists in the country's northern Idlib province also reported heavy clashes between Syrian troops and defectors in the Jabal al-Zawiya region, along the Turkish border.

He said "dozens" of people from both sides were wounded in the fighting, some of them in serious condition.

The Local Coordination Committees activist network said five other people were killed in Syria Saturday, including three in the central city of Homs, one in the eastern city of Deir el-Zour and another in Douma, a suburb of the Syrian capital.

The conflict in Syria has marked the most serious challenge to Assad, who took over from his father in 2000. The U.N. estimates some 5,400 have been killed since March, when the uprising began.

The capital has seen three suicide bombings since late December which the government blamed on terrorist extremists.

The violence comes as the head of an Arab League observers mission was to submit his report to the League's Cairo headquarters. Foreign ministers for the Arab League will meet Sunday in Cairo to discuss the future of the mission, which expired Thursday.

Arab League officials said the organization is likely to extend its observer mission in Syria and increase its numbers, despite complaints from the Syrian opposition that it has failed to curb the bloodshed in the country.

Members of the Syrian opposition have said Arab observers in Syria have failed to curb the bloodshed and many have called for the dispatch of foreign troops to Syria to create safe zones for dissidents, or even a more wide-ranging military mission similar to the air campaign which helped Libyan rebels bring down dictator Moammar Gadhafi last year.

Burhan Ghalioun, head of the main opposition group, the Syrian National Council, was in the Egyptian capital Saturday for talks with Arab League officials ahead of Sunday's meeting.

Security officials in Lebanon meanwhile said the Syrian navy arrested three Lebanese fishermen and confiscated their boat Saturday in Lebanese waters off the northern town of Arida.

EBay results top estimates but outlook is cautious (Reuters)

SAN FRANCISCO (Reuters) ? EBay Inc reported a higher-than-expected quarterly profit on solid growth in its online marketplaces and an increase in transactions processed through its PayPal electronic payments business.

The e-commerce company's shares were up nearly 2 percent in after-hours trading, even though eBay gave a cautious outlook for first-quarter profit and revenue.

The company reported fourth-quarter net income of $2 billion, or $1.51 a share, compared with $559 million, or 42 cents a share, a year earlier. Revenue rose 35 percent to $3.38 billion.

EBay recognized a big gain from the sale of its remaining stake in Skype during the fourth quarter. Excluding that and other items such as stock-based compensation expenses, profit was $788.6 million, or 60 cents a share, the company said.

Analysts, on average, expected eBay to earn 57 cents a share on revenue of $3.32 billion, according to Thomson Reuters I/B/E/S.

EBay is riding an e-commerce growth wave as shoppers buy more items online and through smart phones and tablet computers.

The company benefits from this trend because its online marketplaces charge fees on transactions and other activity. The company's PayPal unit takes a small cut of a rising volume of electronic payments processed on its network.

CAUTIOUS OUTLOOK

EBay forecast first-quarter profit of 50 cents or 51 cents a share and revenue of $3.05 billion to $3.15 billion. Profit for 2012 will be $2.25 to $2.30 a share and revenue will be $13.7 billion to $14 billion, the company added.

Analysts were expecting first-quarter earnings of 54 cents a share and revenue of $3.16 billion. For the full year 2012, analysts estimated earnings of $2.31 per share on revenue of $13.66 billion, according to Thomson Reuters I/B/E/S.

EBay generates about 30 percent to 40 percent of its revenue in Europe, where many economies have been dented by the debt crisis.

The recent decline of the euro against the U.S. dollar reduces the value of sales in euro zone countries when they are converted to dollars by California-based eBay. Currency volatility also restrains cross-border transactions, a profitable source of growth for PayPal.

"They're exemplifying the bearish outlook for the currency by telling people how much the weak euro will affect their earnings in the next quarter. They want to under-promise and over-deliver," said Bill Smead of Smead Capital Management, which owns eBay shares.

"But earnings are going to grow 15 to 20 percent a year for years and all these little wiggles in the short run are just noise," he said.

EBay described the performance of its business in Europe as "stable," while its performance in Asia improved.

The case-and-device approach seems a smart idea, so it feels like one unit -- it even juices your slate when you charge its built-in battery. The trade-off is an extra two pounds of weight, and almost an inch of thickness. Somewhat lighter is the app which rocks effects, a sound library, sampling, supports WIST (Wireless Sync-Start Technology) and works on any iPad -- but you'll need a second-gen tab to use the hardware. Before you bemoan that this is some sort of cash-in, the whole idea is that you can lay down ideas on the (ahem) Fly, and pick them up later back in the studio.
