SCOTTSDALE, Ariz. - Jamie Moyer, at 49 years old, has made the Colorado Rockies starting rotation.

"It is still Jamie Moyer. It's the Jamie Moyer that was pitching prior to the arm injury that cost him the entire 2011 season. It's the same guy," Rockies manager Jim Tracy said Friday before the team's spring training game against the Texas Rangers at Salt River Fields.

"It's the same worker. It's the same professional. It's the same stuff, same velocity, same pitches. When he's right, same type of effectiveness. You're going to venture into this."

Moyer, who is entering his 25th major-league season, posted a 2.77 ERA this spring and beat out 22-year-old Tyler Chatwood and 28-year-old Guillermo Moscoso for a rotation spot.

Moyer will start the Rockies' second game of the season April 7 against the Houston Astros. If he wins, he'll be the oldest player in major league history to earn a victory.

The last player to play in the majors at 49 years old was infielder Julio Franco, who finished out the season with the Braves in 2007 after turning 49 in August.

Moyer will be 50 in November.

The left-hander will follow right-hander Jeremy Guthrie in the rotation and precede right-handers Juan Nicasio and Jhoulys Chacin, who will pitch the home opener April 9 against the San Francisco Giants.

In a move that could save the bullpen in case Moyer has a short outing, he will start after Guthrie, an innings eater who has pitched more than 200 innings each of the last three seasons.

With an off day on April 10, the Rockies will open the season with a four-man rotation. Left-hander Drew Pomeranz will join the rotation and make his first start April 15.

Pomeranz was optioned to Triple-A on Friday.

Moyer missed the 2011 season after undergoing Tommy John surgery. By returning to the majors, he will be the active leader in victories (267), innings (4,020) and starts (628). In his last season, he went 9-9 with a 4.84 ERA with the Philadelphia Phillies in 2010.

Moyer's last start was Wednesday against the Chicago White Sox. He had to work out of trouble and threw 89 pitches in four innings, allowing three runs and seven hits, with three walks.

The following day, Moyer was experiencing normal leg stiffness and displayed "no red flags," Tracy said.

"I think he can still be very, very effective," Tracy said. "He has incredible know-how. He's an incredible pitch maker. When he's right, he can carve a strike zone up."

Tracy informed Moyer of his decision Friday afternoon. Moyer thanked him. "I stopped him right there and said, `Thank you is not necessary because we don't give handouts here. Your professionalism and the way you've handled yourself is immensely appreciated,"' Tracy said.

"He earned it."

Moyer has a career record of 267-204 with a 4.24 ERA in 686 games. He was an All-Star in 2003 with the Seattle Mariners, and he made his major-league debut on June 16, 1986 with the Chicago Cubs.

In corresponding roster moves, the Rockies optioned Pomeranz and Moscoso to Triple-A and reassigned catcher Wilkin Castillo and outfielder Andrew Brown to minor-league camp. To help limit the 23-year-old's innings, Pomeranz will begin the season in the minors and make a start April 10 before joining the Rockies on April 15.

Does surveillance video of George Zimmerman in police custody on the night of Trayvon Martin's death contradict claims that he was beaten and bloodied during an altercation with the Florida teen? NBC's Ron Allen reports.

Updated at 7:09 a.m. ET: Surveillance video footage of George Zimmerman being led from a police car shortly after he fatally shot teenager Trayvon Martin does not appear to show any obvious signs of injuries or bloodstains, but his attorney says the video is too grainy to be revealing.

The footage, obtained by ABC News?on Wednesday, shows a handcuffed Zimmerman getting out of the police car unaided and walking into the police station where he was taken after the shooting in Sanford, Fla.

It was taken about four hours after the deadly incident.?

In the video, there are no readily visible signs of injuries to Zimmerman's head or blood on his clothes. However,?he is wearing a red jacket, which could obscure blood stains. Also, at one point, an officer pauses to look at the back of Zimmerman's head, which he claims was injured by Martin.

Appearing on NBC's TODAY on Thursday, Zimmerman's attorney Craig Sonner described the video as "very grainy." He also pointed out that Zimmerman had been "cleaned-up" and received first aid in the four hours between the incident and Zimmerman's videotaped arrival at the police station.

Sonner has previously said that his client suffered a broken nose and a gash to his head during the altercation.

George Zimmerman's attorney, Craig Sonner, tells TODAY's Matt Lauer that a video of George Zimmerman taken after the killing of Trayvon Martin is too grainy to show whether he had any blood or bruises on his face.

Neighborhood watch volunteer Zimmerman, 28, who was released without charge,?claims he shot dead?the 17-year-old Martin on Feb. 26 in self-defense after the teen attacked him.

Eugene O'Donnell, of John Jay College of Criminal Justice, said the video shows "that it's beyond dispute that there are no serious injuries, physical injuries, he's not in a hospital."

"There's no bruising that's observable," O'Donnell told MSNBC TV's?The Last Word.?However, he added that "it's possible that there are injuries that are not seen in the video."

Richard Kurtz, the funeral director who?prepared Martin's body, was asked if there were any signs on his hands that he had punched someone.

"The only thing that I was able to see was the gunshot wound," Kurtz told The Last Word. "I could not see evidence like he had been punching somebody as the news media say he was punching ... It just did not add up to me."

Jane?s comments are excerpted from the transcript of our panel at the AWP conference in Chicago earlier this month, ?Can the Creative Process Be Taught? Or Will Chicken Soup Do??

My life as a writing teacher has had three phases. The first one was when I was a student at the Iowa Writers? Workshop.?I paid no attention to my teachers at all. They reminded me too much of my parents and I just cut them out. But I found my fellow students to be totally inspiring and I watched them, eavesdropped upon them, and learned from them and gossiped about them all the time, and that was the thing that really kept me going . . . Because their stories were way more interesting to me than my own were.

I don?t remember much of what I wrote . . . But I remember a lot of what my fellow students wrote and that?s because I would take it off the shelf and it would be different; it would be a revelation; it would be something I couldn?t possibly have written. I think one of the great things about a writing program is that the teachers are just supervisory staff and the students are your fellows who are showing you the way, even as they learn the way.

The next phase was when I taught creative writing at Iowa State. When we called people and told them they were accepted to Iowa State, we had to say, ?Ok, now, listen: This is NOT the University of Iowa. This is Iowa State.? And sometimes they didn?t pay attention and didn?t realize where they were coming. . .

But my technique at Iowa State was to divide my class of 14 or 15 students up into smaller groups of 4 or 5. We met once a week for two hours. The semester was 16 weeks long. Everybody turned in a draft every week. That meant they did 16 drafts. And I really did feel that this worked like a charm because the students who were reading the stories then saw the suggestions they had made realized the following week, or not.

Somebody said, ?you should change this guy to do this,? and the person would try it and it wouldn?t work, or it would. The students became very cohesive. I asked them sometimes if they wanted to start shifting around into other small groups and they all said no. It became a cohesive little cell.

But essential to them?and I think this is really important?is that the teachers and the students must talk about the stories in an analytical and not judgmental way. One of the reasons that I eschewed and disdained my teachers at the University of Iowa was that . . . if they liked you, they would praise you or damn you in order to strengthen you. But they weren?t big on analysis . . .

Phase 3 was when I wrote my book called 13 Ways of Looking at the Novel, which is a book about the anatomy and the history of the novel. And there are two chapters in there called ?A Novel of Your Own Part I? and ?A Novel of Your Own Part II.? Half of the book is about analyzing the form of the novel and half of the book is a sort of lengthy bibliography of about 105 or 6 novels that I read in order to write the book.

I learned a lot. That was like going back to school in mid-life and learning more about your field. I have come away from that thinking about novels much differently than I did to begin with. One of the things I learned is that novels are not comparable to one another. You cannot say The Good Soldier is greater than War and Peace which is greater than Remembrance of Things Past because they?re not comparable. It?s like saying a dog is greater than a banana which is greater than a house.

But they do have certain things in common and if you as a reader read enough novels, you will have an instinct about what those things are that they have in common. You as a reader when you start writing your novel, are much more knowledgeable than you are as a writer and so the writer you has to have patience for the reader you and the reader you has to have patience for the writer you. So you write your novel, you keep going, keep going, keep going, you keep going, part of you thinks this is shit; you keep going you keep going, more of you thinks this is shit, but you get to the end of the first draft, you put it aside and you try not to be judgmental of yourself. And then at some point later, you pick it up and the reader you kicks in. And the reader you is not thinking this is shit, the reader you is thinking ?oh I know, this needs a little bit of this here, it needs a little bit of this there, I?ll cut it here, I?ll cut it there.?

The reader you, who has been reading books since The Bobsie Twins and Dick and Jane, has taken in the nature of books, just like the driver you has taken in how to drive an automobile. The writer you is much more of a beginner than the reader you, so let the reader you speak to you . . .

Can writing be learned? Absolutely. . . Absolutely. The one single only thing that you need to write a novel is the absolute desire to write a novel. Everything else is not essential. . .

STRATHAM ? Consensus was the word of the day at the Stratham School District meeting Friday night, with all five warrant articles passing nearly unanimously, a single nay appeared as a beauty spot on the face of Article 1.

The first article up for discussion was the school budget. The school district requested a $9,584,502, an increase of $143,237, or 1.5 percent, over last year?s budget. A portion of the higher spending was incurred by an increase in retirement funding due to the state down-shifting costs.

?In recent years, we have seen costs passed down from the state after budget is passed,? said Susan Canada, a member of the Budget Advisory Committee. ?As a community, we expect high standards from our elected officials. The challenge is to accomplish this without significant budget increases. The budget tonight reflects commitment to education.?

The proposed change in tax impact for the budget alone would be 17 cents per thousand dollars of assessed value.

Next discussed was Article 2, which is this current year?s proposed teacher?s contract. Under the contract, the teachers will receive a salary increase tied to the cost of living adjustment and capped at 1 percent for the first year and 2.5 percent for the subsequent years. There will be an increase of $33,271 in fiscal year 2012-2013, and estimated increases of $118,939 and $130,591 in the subsequent two years. The contract will impact taxes by 2.8 cents in its first year. There will be increasing contributions by the teachers to their health plans, with the most common planning going to a 21 percent contribution by the end.

?After last year?s vote, we sat down with the leaders of the Stratham Teacher?s Association and worked to get a contract that the voters of Stratham will support,? said School Board Chairman Travis Thompson. ?Collectively, I think we have a very positive contract together this evening.?

?We were opposed for a number of reasons last year, but this year we endorse the proposal,? said David Canada, chairman of the Board of Selectmen. ?We have great respect for our teachers and the single most important factor in the equation is teacher caliber: Are they top notch? As such, they deserve good pay and good benefits. We would like to applaud teachers for listening to voters.?

A resident asked about the tax impact of the second and third years of the teachers? contract was. SAU 16 Superintendent Mike Morgan said the tax rate increase would be about 7 cents per thousand for the second year.

Article 3 called for transferring a $75,000 surplus from the general fund this year to the Special Education Trust Fund. The fund is different from standard special education budgeting because it is reserved for paying unanticipated education expenditures. The fund currently has $75,000 in it. The article will impact the tax rate by about 4 cents.

Evelyn Willing To Marry Into An Open Relationship With Chad ...

If you are in a high profile relationship with a baller, musician or movie star and your man cheats, do you break it off and keep it moving or accept the fact that famous men cheat and settle for an open relationship? Evelyn Lozada and Chad Ochocinco are about to take that giant leap of faith and walk down the aisle this summer despite rumors that Chad has been getting it in on the side. In this past week?s? episode of Basketball Wives Chad basically told Evelyn that while he?s out on the road, he may want to have sex, and Evelyn told him that if that happens, she would like for him to tell her about it and wrap it up because then she?ll have more respect for him.

?I want you to be 100 with me. I?d rather know. Tell me1 I wanna know. Go to the pharmacy and get condoms. I?mma be sick like a motherf?ker but what can I do but respect you and know that you?re telling me the truth rather than hide it. Because at the end of the day you don?t have to tell me nothing. I don?t want to have to babysit you but I?d rather you be real with me because Lord knows what could happen.?

Then Chad suggested that if he and Evelyn were out together and he saw a female that he was attracted to, they ? as a couple ? should be able to ?bring her home.? Evelyn wrote on her blog that it?s not that she?s just accepting that Chad will cheat but she?s been real about the situation she?s getting herself into by marrying a pro-athlete.

?I am a realist as to the world we live in. When your relationship is high profile and publicized like mine, I don?t put anything past anyone. Who is to say that either one of us will eventually fall into that temptation one day? We don?t know that.?

?My thing is, I want to take my wedding vows and say, we want this to be forever, but you never know.?

?I am not condoning Chad for cheating? There will be temptation, but it takes a strong bond to defeat it. We do love each other and are both focused on making this work? I love Chad, my focus is him and vice-versa and we are going to do this thing and work it out. There is an abundant amount of negativity and it isn?t easy. It has been a challenge, but this is my dude and I love him.?

Dry eye syndrome is one of he causes of epiphora. It causes the human eye to become really dry and as a result the eyeballs become itchy and uncomfortable. The lacrimal gland will then receive the impulse and will carry out the response by producing so many tears that in the long run overcome the innate drainage system of the eye.

Allergic reactions caused by allergens such as grass and pet dander are also responsible for epiphora. This is because the reactions usually causes the eyeballs to turn red thus becoming irritating and itchy. Burning is also another effect of such a reaction. This will eventually prompt the production of tears in excessive amounts leading to watering.

Some other infections like the conjunctivitis and blepharitis are also leading causes of epiphora. Wearing contact lenses may also trigger the risk of conjunctivitis. Irritants are another factor that accelerates the condition. Excess tears will usually be produced in the presence of bright light, wind, exposure to certain treatments just to mention but a few.

Watery eyes are a symptom and not a cause of eye distress as most people think. The condition can lead to irritation, itchiness and discomfort but unless it comes with pain and red coloration, the excess tears should not put people in panic as it is not a serious problem. Some of the remedies include artificial tears and prescriptions on medicated eye drops. Wearing of sunglasses is not a bad idea same to drinking plenty of water as it helps maintain a healthy tearing. watery eyes

Do managers of Delaware LLCs have the same fiduciary duties as ...

Recently, the Delaware Court of Chancery issued a ruling on the question of whether a manager (or managing member) of a Delaware limited liability company owes fiduciary duties to the company and its members. ?The court ruled that it does.

As a legal practitioner, this result is unsurprising. ?I think most business lawyers, both when representing LLC managers and when representing LLCs and their members, operate under the assumption that a manager owes a fiduciary duty of care and loyalty to the company and its members.[1] ?What is somewhat surprising is (a) that this conclusion was ever in doubt and (b) more importantly, in light of recent comments made by the Chief Justice of the Delaware Supreme Court, this conclusion may still be in doubt if the ruling is appealed.

The case is called Auriga Capital Corporation v. Gatz Properties, LLC. ?It arose from a failed golf course venture, where the land on which the golf course is situated was leased by an LLC from a family affiliate of the LLC?s manager. ?The LLC was funded by outside investors who owned a minority interest in the LLC. ?The LLC then subleased the land to American Golf Corporation. The terms of the sublease permitted American Golf to terminate its sublease in early 2010. Because the golf course was unable to operate profitably, American Golf exercised its early termination option. ?Ultimately, the LLC was put up for auction and was bought by the manager at a low price, resulting in a large investment loss to the minority members. ?The minority members filed suit alleging that the manager engaged in a pattern of intentional mismanagement, including rejecting a serious offer from a 3rd party for a purchase of the LLC that would have earned the minority members a full return on their investment. ??They further alleged that this intentional mismanagement constituted a breach of the manager?s fiduciary duties.

One of the issues in contention was whether, in the absence of any language explicitly addressing the issue, a manager of a Delaware LLC owes fiduciary duties to the company and its members. ?While the Delaware Limited Liability Company Act does not expressly provide that the traditional fiduciary duties of care and loyalty apply by default to the managers or members of an LLC, the court concluded that such duties are implicit. Indeed, the Delaware General Corporation Law also does not explicitly provide for fiduciary duties for a corporation?s management and yet they are indisputably present.

This conclusion is in line with the expectations of most parties to Delaware LLC operating agreements and with the expectations of most attorneys who draft them. ?However, whether this conclusion will be upheld on appeal is somewhat in doubt. ?At a recent seminar, Chief Justice of the Supreme Court of Delaware Myron Steele stated that ?[c]ourts should not imply traditional fiduciary duties when LLC agreements are silent.? ?He based this on the fact that limited liability companies are new entities based on contracts and are not derived from common law. ?Given that Delaware?s LLC Act emphasises freedom of contract (in section 18-1101(b)) and that contract law provides some level of protection to parties of LLC operating agreements through the implied covenant of good faith and fair dealing, his conclusion was that if an LLC?s operating agreement does not expressly provide for fiduciary duties of managers, ?courts should assume the parties did not want [fiduciary duties] to apply at all.? ?These statements are in direct contradiction to the holding of Auriga, and if Chief Justice Steele should find that two or more other justices on Delaware?s Supreme Court agree with him, the holding may be overturned on appeal. [2]

In light of this decision and in Chief Justice Steele?s subsequent comments, drafters and parties to LLC operating agreements should be careful to include unambiguous language on whether they intend to include, eliminate, or restrict fiduciary duties. In addition, while this is not a new issue, in contrast to the Delaware General Corporation Law or the limited liability company acts of many other states, Delaware?s Limited Liability Company Act permits parties to an LLC operating agreement to waive a manager?s fiduciary duties. ?This itself may come as a shock to many seasoned corporate practitioners since fiduciary duty, especially the duty of loyalty, is generally regarded as an unwaivable duty in many other situations.
